1. Introduction 

Welcome to Lou Heller Stylist, operated by Lou Heller Style Limited, hereafter referred to as "we", "us", or "our". By accessing our website, engaging in our personal styling services, purchasing our products, purchasing our Style Journal, or subscribing to our services, you agree to comply with and be bound by the following terms and conditions of use. Please read these terms carefully before using our services. 

2. PERSONAL STYLING SERVICES

  • By engaging in our personal styling services, you agree to provide accurate information about your preferences, sizing, and any other relevant details to facilitate the styling process.
  • Payment for personal styling appointments must be made upon purchase/booking. Deposits/payments are to secure the appointment and are non-refundable.
  • Your session will begin and last the duration it is booked for and it is your responsibility to arrive on time. On the occasion when a styling session runs over, extra time may be charged per half an hour for the stylist.
  • Personal styling services may be provided at our designated location or at a location of your choice, and travel fees are included in your package.
  • We understand that circumstances may arise that require rescheduling or cancellation of appointments. Please refer to our rescheduling and cancellation policy below.
  • We reserve the right to reschedule personal styling services due to unforeseen circumstances. In such case we will provide options for rescheduling or refunds. Please refer to our rescheduling and cancellation policy below.

3. Group Speaking Events

  • Participation in our group speaking events may require registration and payment of a fee, as specified.
  • To secure Lou for any Group Speaking Event you will be invoiced $500 upon booking. This is non-refundable from the time of booking, unless we cancel 14 days prior to event then you will be reimbursed the full amount.
  • We reserve the right to cancel or reschedule group speaking events as necessary, in which case registered participants will be notified and provided with options for rescheduling or refunds.

4. Style Travel Events

  • Participation in our style travel events may require registration, payment of a deposit, and adherence to specific terms and conditions, including travel arrangements and accommodations.
  • Flights, accommodation and Travel Insurance are the responsibility of the client, and to be booked by the client. We highly suggest getting Travel Insurance for the Style Travel Events so you are covered for unforeseen circumstances.
  • To secure your registration on any National Style Travel Event you will be invoiced $500 upon booking. This is non-refundable from the time of booking, unless we cancel 14 days prior to departure then you will be reimbursed the full amount.
  • To secure your registration on any International Style Travel Event you will be invoiced $1000 upon booking. This is non-refundable from the time of booking, unless we cancel 14 days prior to departure then you will be reimbursed the full amount.
  • We understand that circumstances may arise that require rescheduling or cancellation of appointments. Please refer to our rescheduling and cancellation policy below.

5. Style Journal

  • The Style Journal is provided as a digital file and/or printed version for personal use only. You may not share, distribute, or reproduce the content of the Style Journal without prior written consent from Lou Heller Stylist Limited.
  • Sharing the Style Journal with others, including but not limited to friends, family, or social media followers, is strictly prohibited and may result in legal action.

7. Event Ticketing

  • Full payment for the event ticket is required at the time of purchase.
  • Ticket purchases are final and non-refundable unless the event is cancelled by the organiser.
  • In the event of cancellation, purchasers will be notified, and refunds will be issued in full within 7–10 business days.
  • Your health and safety are our priority. Please follow any health and safety guidelines provided by the venue.
  • The organizer reserves the right to make changes to the event schedule, location, or featured activities. Any significant changes will be communicated to all attendees as early as possible.
  • By purchasing a ticket, you agree to these terms and conditions.

8. Gift Cards

  • Please treat the electronic gift card as cash.
  • Any person who learns of this Coupon Code can use it, therefore it is your responsibility to keep this Gift Card safe, by keeping the Coupon Code private.
  • We recommend you keep the Gift Card email safe and take all measures necessary to secure your email.
  • Lost or stolen Gift Cards will not be replaced or refunded.
  • Not redeemable for cash.
  • The expiration date of the card is 12 months from delivery.
  • Gift Cards can only be redeemed online at louheller.com. The purchase of an Gift Card is not refundable.

9. Rescheduling and Cancellation

  • For personal styling services, group speaking events, and style travel events, you may reschedule or cancel your appointment or registration up to 14 days prior to the scheduled time without penalty, however any deposits made to secure your booking are non-refundable.
  • We reserve the right to reschedule personal styling services due to unforeseen circumstances. In such case we will provide options for rescheduling or refunds.
  • Cancellations made 14 days of the scheduled appointment or event may be subject to a cancellation fee. In case of extreme circumstances, we will attempt to accommodate.
  • To reschedule or cancel an appointment or event, please contact us as soon as possible. Failure to provide timely notice of cancellation may result in forfeiture of any deposits or fees paid.
  • We reserve the right to cancel or modify style travel events due to unforeseen circumstances or insufficient participant numbers. In such cases, registered participants will be notified and provided with options for rescheduling or refunds.
  • For subscriptions, you may cancel your subscription after 3 months, but no refunds will be provided for the remaining subscription period.

10. Payment and Fees

  • Payment for personal styling services, group speaking events, style travel events, Style Journal, and subscriptions is due at the time of booking or purchase, unless otherwise agreed upon.
  • We accept payment via Cash, Credit Card, Afterpay and Laybuy, and all prices are listed in NZD and are subject to GST.
  • All fees are non-refundable unless otherwise specified.
  • All invoices must be paid within 3 days.
  • Late Payment Fee: A late payment fee of 2% will be applied to any invoice unpaid after the due date.
  • Interest on Overdue Payments: Any invoice not paid within 14 days of the due date will incur interest at a rate of 4% per month.
  • Late Fee Charge: A late fee of $50 will be added to the outstanding balance for any overdue payment.
  • Credit Card Processing Fee: A 2.9% processing fee will be added for payments made via credit card.
  • CC Transaction Fee: Payments made using a credit card will be subject to a $0.30 transaction fee to cover processing costs.

11. Intellectual Property

  • All content provided through our services, including but not limited to images, text, graphics, logos, and designs, is the property of Lou Heller Stylist Limited or its licensors and is protected by copyright and other intellectual property laws.
  • You may not reproduce, distribute, modify, or otherwise use any of our content without prior written consent.

12. Relationship with Stores

  • We do not act as an agent for any of the stores to which we may introduce you or accompany you for shopping.
  • Contracts for the purchase of goods are between you and the relevant store and the terms and conditions of sale and requirements regarding price, returns, defects and all other issues will be such as the store may impose or as you may agree with the store.
  • We have no liability for the quality, condition or performance of any goods which you may purchase during, or as a result of, the provision of Services by us.

13. Privacy Policy

We are committed to protecting your privacy and safeguarding your personal information. Please refer to our Privacy Policy for details on how we collect, use, and disclose your information.

14. Limitation of Liability

  • To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, or data, arising out of or in connection with your use of our services.
  • Our total liability for any claim arising out of or relating to these terms and conditions shall not exceed the amount paid by you for the relevant service or product.

15. Modifications to Terms

We reserve the right to modify these terms and conditions at any time, and such modifications shall be effective immediately upon posting on our website. Your continued use of our services after any such modifications constitutes your acceptance of the modified terms.

16. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of New Zealand and Australia without regard to its conflict of law principles.

The Lou Effect - Membership T's and C's

1. Membership Tiers/Benefits Clarification

Memberships may include access to exclusive content, discounts on personal styling sessions, or other benefits as specified for each tier. Our memberships are available in the following tiers:

  • Essential: This tier includes benefits such as
  • Elevated: This mid-level tier offers benefits
  • Elite
  • Exclusive

Exact benefits for each membership tier will be provided at the time of purchase and are subject to change.

2. PAYMENT

  • Payment for memberships is due at the time of purchase and on a monthly basis thereafter.
  • All prices are listed in NZD and are subject to GST.
  • Payment will be automatically taken from the form of payment provided when joining the membership plan.
  • Please access your membership portal to change your payment method.
  • Memberships are automatically renewed unless cancelled by the subscriber.
  • All membership fees are non-refundable unless otherwise specified.

3. Changes to Memberships and Pricing

We reserve the right to modify the membership benefits, pricing, or terms at any time. In the event of any such changes, members will be notified via email at least 30 days before the changes take effect. Continued use of the membership after the effective date of such changes constitutes acceptance of the new terms.

4. Payment Failures

If your payment method fails, reattempts will be made. You will be notified and given a grace period of 7 days to update your payment details. If the payment issue is not resolved within this time, your membership may be suspended, and you will lose access to all membership benefits until payment is successfully processed.

5. Upgrade/Downgrade Policy

Members have the option to upgrade or downgrade their membership plan at any time. Upgrades will take effect immediately, and any pro-rated fees for the current billing cycle will be charged. Downgrades will take effect at the start of the next billing cycle. To request an upgrade or downgrade, please email admin@louhellerstylist.com.

6. Cancellation Policy for Memberships

  • Minimum Commitment: This membership requires a 6-month minimum commitment. Cancellation is only available after the first 6 months of membership.
  • Notice Period: To cancel your membership after the initial 6-month period, you must provide a 1-week notice before your next billing cycle. Cancellation requests can be submitted via email at admin@louhellerstylist.com.
  • How to Cancel: Send an email to admin@louhellerstylist.com with the subject line "Membership Cancellation Request." Include your full name, membership ID, and the reason for cancellation (optional).
  • Final Billing: If your cancellation request is submitted within the 1-week notice period, you will not be charged for the next billing cycle. Any requests made after the notice period will result in one final charge.
  • Early Termination Fees: If you wish to cancel before the 6-month commitment is completed, an early termination fee equivalent to one month's membership fee will be applied. Any benefits due at the end of the 6-month term will be forfeited upon early cancellation.
  • Access During Cancellation: You will retain full access to all membership benefits until the end of the billing cycle in which the cancellation becomes effective.
  • Refunds: No refunds are provided for any unused portion of your membership.

7. Data Privacy

We are committed to protecting your privacy. Your personal data will only be used in accordance with our Privacy Policy, which outlines how we collect, store, and process your information. 8. Intellectual Property & Content Usage

All content provided as part of your membership, including styling tips, videos, and exclusive materials, is for your personal use only. You are not permitted to share, distribute, or reproduce any content provided without explicit written permission. Violation of these terms may result in the immediate termination of your membership.

9. Termination by Business

We reserve the right to terminate or suspend your membership at any time if you violate any terms or engage in fraudulent or inappropriate behaviour. If we terminate your membership, we will notify you via email, and any remaining access will be revoked immediately. No refunds will be issued in cases of termination due to violation of terms.

10. Force Majeure

We will not be held liable for any delay or failure to provide services due to circumstances beyond our control, including but not limited to acts of God, natural disasters, government actions, or interruptions in communication services. In such cases, we will make reasonable efforts to resume services as soon as possible.

11. Governing Law and Jurisdiction

These terms are governed by the laws of New Zealand. Any disputes arising from or related to the membership will be subject to the exclusive jurisdiction of the courts in New Zealand.
